Welcome to La Bonne Fille Inc.’s webstore (“La Bonne Fille”, “we” or “our”).
La Bonne Fille provides small offerings of teas and accessories for sale both online through our webstore hosted at labonnefilletea.com.
This document and any documents referred to within it (collectively, our “Terms of Service” or “Terms”) set out the entirety of the terms of use for La Bonne Fille’s webstore, as well as the rights and obligations of our Customers (as further defined below).
La Bonne Fille’s Terms of Service may be modified or updated at any time we deem necessary, in our sole discretion and without notice, and as such we recommend that you check this webpage from time to time to review any changes. If we do update these Terms, the “Effective Date” noted above will indicate when the changes were introduced, and as such your continued use of our webstore is deemed to constitute your consent to any such changes.
By browsing our webstore or purchasing our products (collectively, “Services”), you represent that you have reviewed and understand these Terms, and expressly consent, without limitation or qualification, to being bound by them.
Definitions
- Customers (or “you”) when referred to in these Terms means anyone browsing La Bonne Fille’s webstore or using our Services.
- Purchased Goods when referred to in these Terms the means products purchased from La Bonne Fille using our Services.
- Transaction when referred to in these Terms means the financial exchanges on La Bonne Fille’s webstore where Customers buy Purchased Goods.
Use of Our Webstore
By browsing La Bonne Fille’s webstore or using La Bonne Fille’s Services, you acknowledge and warrant that any information that you provide, post, transmit or submit to our webstore does not infringe on your rights, infringe on any third party’s rights, or constitute a criminal offence or give rise to civil liability. You also acknowledge and warrant that you will not provide, post, transit or submit any information that will cause damage to either La Bonne Fille’s webstore or any of La Bonne Fille’s Customers.
Customer Accounts
La Bonne Fille uses the third-party provider Shopify Inc.’s application (“Shopify”) or e-commerce platform to sell its products online (please see the “Shopify” section in our Privacy Policy, a link to which is provided below) and accepts all major credit cards.
As such, Customers use their Shopify accounts to complete Transactions on La Bonne Fille’s webstore and are responsible for maintaining the security of their accounts and should take reasonable care to protect their passwords or information. Should any charges be made to your account or damages occur due to your failure to take reasonable care of your account or password information, you agree to be held solely responsible.
In addition to fiat currency, we also accept Bitcoin cryptocurrency, and Bitcoin cryptocurrency-based payments can be made directly to La Bonne Fille’s official cryptowallet.
Privacy Policy
Please take the time to read and familiarize yourself with La Bonne Fille’s Privacy Policy (“Policy”).
We recommend checking this Policy frequently, as we may update our Policy from time to time in order to maintain compliance with Canadian personal information privacy laws and regulations.
Ordering From La Bonne Fille
Orders submitted by Customers to La Bonne Fille’s webstore are deemed to be offers to La Bonne Fille, and as such we reserve the right to accept or refuse orders at any time and for any reason, including but not limited to the availability of the products in question, and/or if the products have an incorrect description or price on our webstore.
La Bonne Fille reserves the right to vary or to cease to make available any of its offered products at any time without notice, and all discounted products are subject to final sale.
Shopify must approve all Transactions completed via credit card.
In the event that your order is cancelled or refused, La Bonne Fille will send you an email confirmation clarifying the same. If such cancellation or refusal is after a Transaction has been completed, we will reimburse you for the full amount that has been paid.
Customers agree not to resell any Purchased Goods bought from La Bonne Fille, nor to transfer any of their rights described herein without the prior written consent of La Bonne Fille.
Our Shipping Policy
La Bonne Fille uses Canada Post to ship Purchased Goods to our Customers.
Estimated arrival times for Purchased Goods should be considered as an estimate only, and although La Bonne Fille will make commercially reasonable efforts to ensure that orders are shipped on time, La Bonne Fille shall not be responsible for any damages due to delays in shipping.
La Bonne Fille relies on Canada Post to ship Purchased Goods, and as such shall not be held liable for any loss, damage (direct or indirect) or expense occurring due to shipping and/or while Purchased Goods are in transit.
After Customers complete a Transaction for Purchased Goods on La Bonne Fille’s webstore, title and risk of loss shall pass to Customers the moment that the Purchased Goods are transferred to Canada Post.
The shipping charges applicable to Purchased Goods will be listed and/or displayed when you purchase products from La Bonne Fille’s webstore. Customers are responsible for all necessary federal and provincial shipping-related taxes, and agree to comply with all applicable export laws of Canada that apply to Purchased Goods.
Our Return Policy
Although we hope that instances requiring the return of Purchased Goods are minimal, we understand that returns are occasionally necessary.
La Bonne Fille will only issue refunds to the same credit card that was used to complete the initial Transaction.
Intellectual Property Rights
All of the material or content displayed or otherwise posted or accessible through La Bonne Fille’s webstore are owned by La Bonne Fille and/or third party content suppliers, and as such are protected by, including but not limited to, the Copyright Act, R.S.C., 1985, c. C-42 and Trademarks Act, R.S.C., 1985, c.T-13 o the federal laws of Canada.
Customers agree not to reproduce, copy, print, transmit, publish, distribute or make any similar use of the content displayed or otherwise posted on La Bonne Fille’s webstore and no provision or interpretation of these Terms shall be deemed or construed as granting Customers a licence for any aspect of the various forms of intellectual property contained herein.

Indemnification
All Customers using or browsing La Bonne Fille’s webstore agree to indemnify, defend and hold La Bonne Fille, its officers, directors, employees and agents harmless (including reasonable legal fees) against any and all liabilities, claims or causes of action arising from or related to La Bonne Fille’s webstore and/or La Bonne Fille’s webstore’s use or misuse or the breach of any of the provisions of these Terms.
